The result of the Runcorn and Helsby by-election, held on 1 May 2025, is being challenged in the High Court by Graham Moore, a candidate from the English Constitution Party (“ECP”), who claims the outcome was erroneous and potentially fraudulent.

If, through this case, election fraud is proved to be systemic in England, it has serious ramifications for the Labour Party’s victory in the 2024 general elections.

Moore, who received 50 votes in the election, alleges that the vote count did not reflect his expected tally and has called for the result to be annulled.   His petition includes claims of interference from Royal Mail, which he alleges failed to deliver approved campaign leaflets, and Cheshire Police, whom he accuses of harassing ECP campaigners and failing to investigate election interference, including the removal of an ECP Wikipedia page.

He will also submit that the “first-past-the-post” voting system is being undermined by the use of an ad hoc “Alternative Vote” system, which is unlawful.

The High Court will hear the case.  A directions hearing to set a court date was scheduled for 13.  After the directions hearing, a date after 1 October 2025 was set for a trial hearing; although during the directions hearing, the judge mentioned 2 October as a possible date.

The by-election, which saw Sarah Pochin of Reform UK win by a margin of six votes, was triggered by the resignation of Labour’s Mike Amesbury following his conviction for assault.

The recent parliamentary by-election for the Runcorn and Helsby constituency, held on 1 May 2025, has been formally challenged in the High Court of Justice, King’s Bench Division. Graham Moore, the candidate for the English Constitution Party (“ECP”), has filed an election petition alleging a range of serious irregularities, including a fraudulent vote count, interference by Royal Mail and harassment by Cheshire Constabulary.

Moore’s petition, which seeks to have the election declared void and an independent recount ordered, names several key respondents: Emma Gilthorpe (Group Chief Executive Officer, Royal Mail), Mark Roberts (Chief Constable, Cheshire Constabulary), Sarah Joanne Pochin MP (the elected candidate for Reform UK), and Stephen Young (Returning Officer, Halton Borough Council).

Grounds for the Challenge

The petition outlines several compelling reasons for challenging the by-election result.

“Statistically Impossible” Identical Vote Counts

Moore officially received exactly 50 votes in the Runcorn and Helsby by-election, as declared by the Returning Officer on 2 May 2025.  Crucially, Moore also received exactly 50 votes in the Tooting by-election on 16 June 2016.

The petition highlights that these two constituencies are distinct, with different voter bases, candidates and political contexts, administered by councils controlled by mainstream parties (Labour-controlled Halton in 2025 and Conservative-controlled Wandsworth in 2016).

Moore argues that the probability of receiving identical vote totals in two unrelated parliamentary elections, nine years apart, is “not just strange but impossible.” This identical result is considered statistically implausible and indicative of deliberate fraud, potentially facilitated by the use of bundle counts (typically in 25s or 50s).

No other candidate in UK parliamentary by-elections or general elections, to Moore’s knowledge, has received the exact same vote total in different constituencies.

Similar alleged electoral fraud involving refusal of recounts has been observed by Moore and other independent candidates in other elections, such as Batley and Spen (2021) and Rochdale (2025).

Royal Mail’s Interference via Non-Delivery of Election Leaflets

Royal Mail allegedly failed to deliver pre-approved ECP election communication leaflets to constituents in Runcorn and Helsby, despite delivering leaflets for all other candidates.

Emails from Royal Mail confirmed full delivery by 23 April 2025, but constituent statements of truth contradict this, confirming non-delivery in multiple areas.

This failure is deemed election interference, potentially suppressing Moore’s vote total and creating a “chilling effect on passive democracy” by discouraging non-mainstream candidates who rely on such communication.

Cheshire Constabulary’s Harassment and Failure to Act

A specific Cheshire Police officer is accused of harassing the ECP campaign by imposing unreasonable demands, such as requesting detailed information about campaign events (number of people, nature of event, advertising and time) that were not applied to other parties.

The same officer allegedly gave false information regarding the reporting of election-related concerns, contradicting the designated point of contact for election security.

Cheshire Constabulary reportedly failed to investigate the removal of an ECP Wikipedia page during the election period, despite being notified, claiming a lack of resources or inclination.

These actions are said to have disrupted the ECP’s campaign, suppressed voter access to information, and breached fair election principles, further contributing to a “chilling effect on passive democracy.”

Constitutional and Human Rights Violations

The petition cites the constitutional principle established in Ashby v White (1703), which holds that every elector’s vote must be counted accurately, as the right to vote underpins governance by consent.

It argues that denying or miscounting votes violates the principle that laws and taxes are levied only by consent of the governed, even if the individual ballot doesn’t affect the winner.

Furthermore, Moore asserts violations of the English Bill of Rights 1689 (free elections), the UN Declaration on the Rights of Indigenous Peoples (2007) and International Law on Self-Determination (claiming the English people as an indigenous group denied self-determination), and Article 3 of Protocol 1 of the European Convention on Human Rights (“ECHR”) (right to free elections).

Relief Sought

Graham Harry Moore is requesting the Election Court to:

• Declare the Runcorn and Helsby by-election result of 2 May 2025 void.

• Order an independent recount of every individual ballot, not just bundle counts, to be conducted in a neutral location outside the jurisdiction of Halton Borough Council or Cheshire Constabulary. This recount should involve an independent counting team and impartial observers, potentially using electronic counting machines for accuracy.

• Show the people the exact ballot votes to provide a true picture of the electorate’s will and restore public trust.

• Investigate the roles of the named respondents in the alleged fraudulent count, leaflet non-delivery, campaign harassment, and election interference.

• Grant further relief, including punitive damages and financial deterrents.

The English Constitution Party, led by Moore, states that these alleged actions undermine its mission to ensure fair representation and consent-based governance, deterring non-mainstream English candidates from participating in democracy.

Why Is This Court Case So Important?

In an interview with Pilled podcast last month, Moore said: “If the judge can see this is systematic fraud …  this could easily bring down the government because the election in 2024, July the 4th 2024, was crooked. And once you show systemic corruption within the election system, the world will see it.”

What Happened at the Directions Hearing?

In a video posted after the directions hearing on 13 June, Moore published an update.  During the directions hearing, the Judge mentioned a possible date for a trial hearing as 2 October 2025.  Subsequently, Moore received notification from the court that the date for a trial hearing will be after 1 October.

He noted that, interestingly, there were two people from the American Embassy who attended the hearing. “There were two Americans sitting in the gallery, from the American embassy, who made it known, I believe, to the usher that they are keeping an eye on the case,” Moore said.

Moore had written letters to the US Secretary of State, Marco Rubio, to inform him about his case and the “severe cheating” in elections in England. He believes these letters sparked an interest from the Americans.

Referencing Ashby vs. White (1703), Moore said, “We are governed by consent, and [our] votes must be allocated to who we voted for.”  Part of his future court submission addresses the misallocation and misrepresentation of votes cast by using an “Alternative Vote” system.

The UK uses the “first-past-the-post” voting system.  First-past-the-post is a single-winner voting rule where voters select one candidate and the candidate with the most votes wins, even if they do not have a majority. As Moore said, “[our] votes must be allocated to who we voted for.”

In 2011, the UK held a referendum on whether an “Alternative Vote” system should be used for electing Members of Parliament.  The result of the referendum was a clear “No” vote, with 67.9% of voters opposed to changing the electoral system to the Alternative Vote. But, Moore said, we are witnessing them deploying an Alternative Vote system ad hoc without our consent and against our wishes.

The Alternative Vote system is a preferential voting system where voters rank candidates in order of preference. Under this system, voters would still be electing one candidate associated with a geographic constituency, but they would rank the candidates in order of preference rather than voting for a single candidate.

If a candidate receives more than half of the first preference votes, they are elected outright. If not, the candidate with the least first preference votes is eliminated, and their votes are redistributed according to the second (or next available) preference marked on the ballot paper. This process continues until one candidate has more than half of the votes and is elected.

They are “deploying an Alternative Vote system against your wishes by allocating your vote to their party and not the party of your choice,” Moore said. “And that is highly unlawful. It is a double whammy because we had a referendum on it.”

Any voter can file an election petition.  “[The Labour Party] cheated in the general election of 2024.  We know they did that. And people haven’t got the bottle to bring a petition like this,” he added.
