While the eSafety Commissioner possesses the legal authority to ask the court to cease a service, this power has not yet been used in Australia.

The following is a summary of the article ‘Australia Could Ask Court to Ban Telegram Nationwide’ published by Reclaim the Net.

On 30 July, Australia’s eSafety Commissioner announced it had initiated civil penalty proceedings against social media platform Telegram, alleging violations of Australia’s Online Safety Act 2021. 

The regulator alleges that Telegram failed to comply with the ‘Relevant Electronic Services Standard’, which took effect in December 2024.  The Standard, which covers messaging, email, dating apps and online gaming, requires service providers to proactively prevent, detect, deter and disrupt material that does not meet the regulator’s standards.

The regulator’s court filing claims that between July and October 2025, Australian users reported twelve posts containing pro-terror content to Telegram; the regulator alleges Telegram removed only two, leaving ten accounts and their associated material accessible for up to three weeks.

The eSafety Commissioner further alleges that Telegram failed to detect and prevent the distribution of footage related to the 2019 Christchurch mosque shooting and the May 2022 Buffalo supermarket attack, claiming the latter remained on the platform for nearly three months.

Additional allegations include that Telegram failed to maintain terms of service prohibiting pro-terror content across all parts of its platform and failed to inform complainants about the outcomes of their reports.

Telegram has stated it will contest the case in court, asserting that its anti-terrorism efforts are well-documented.  On the ‘Safety’ page of its website, Telegram states that in 2026, the platform blocked 155,114 terrorist-related communities and removed 200 million pieces of terrorist content through partnerships with organisations like ETIDAL, the Global Centre for Combating Extremist Ideology.

Hinting at requesting the Federal Court ban Telegram across the country, Australia’s top censor Julie Inman Grant, who last year led Australia’s world-first ban on social media for under-16s, told the BBC that “we could apply to the federal court and ask that the service be ceased.”

“We’ve never used those powers,” she said. “We’ll see how this all plays out and whether that kind of action is warranted.”
