Morrisons and Sainsbury’s have announced they will BAN customers who refuse to wear face covering’s.

Morrisons Chief Executive David Potts said – “From today we are further strengthening our policy on masks.” Pots also added that security guards at the UK’s fourth-biggest supermarket chain will be enforcing the new rules.

He stated “Those who are offered a face covering and decline to wear one won’t be allowed to shop at Morrisons unless they are medically exempt.”

Sainsbury’s Chief Executive Simon Roberts said Sainsbury’s would be putting trained security guards at the front of its stores to “challenge shoppers” who do not comply. He continued by saying – “I’ve spent a lot of time in our stores reviewing the latest situation over the last few days and on behalf of all my colleagues, I am asking our customers to help us keep everyone safe.

“The vast majority of customers are shopping safely, but I have also seen some customers trying to shop without a mask and shopping in larger family groups.

“Please help us to keep all our colleagues and customers safe by always wearing a mask and by shopping alone. Everyone’s care and consideration matters now more than ever.”

Asda have also announced that they will extend their Covid Marshals hours to ensure compliance with the draconian, unscientific rules.

So that’s 3 of the UK’s major supermarkets who are essentially now saying you’re not welcome if you have any form of disability. Which equates to 1 in 6 people who are now not welcome in the large supermarket stores.

The UK seems to be moving further into what has come a fusion of fascism and communism, and we’ve a feeling it’s only going to get worse.

It’s important to remember your rights if you happen to be confronted by one of these Covid Marshals when you go out to do your weekly shop. So we’ve done the hard work for you and found everything you need to know.

The current statutory instrument in place directing the wearing of face coverings in shops is ‘The Health Protection (Coronavirus, Wearing of Face Coverings in a Relevant Place) (England) Regulations 2020’. This statutory instrument states that ‘No person may, without reasonable excuse, enter or remain within a relevant place without wearing a face covering.’ So the question is, what is a reasonable excuse? Well the statutory instrument (vaguely the law) states the following –

‘For the purposes of regulation 3(1), the circumstances in which a person (“P”) has a reasonable excuse include those where—

(a)P cannot put on, wear or remove a face covering—

(i)because of any physical or mental illness or impairment, or disability (within the meaning of section 6 of the Equality Act 2010(1)), or

(ii)without severe distress;’

So here we have written in law the reasonable excuses for not wearing a face covering. Now we would argue that conforming to terrible science and wearing a face covering is enough to cause anyone severe distress, but you’re free to do as you please.

Now Morrisons and Sainsbury’s have stated they will have security guards at the door now who will “challenge” shoppers if they are not wearing a face covering. Well we are pleased to inform you that they have no legal right to “challenge” you. There is absolutely nothing written in the above statutory instrument that says anyone is allowed to challenge you for not wearing a face covering, however the Government’s own guidance on the law states this –

‘If you have an age, health or disability reason for not wearing a face covering:

  • you do not routinely need to show any written evidence of this
  • you do not need show an exemption card

This means that you do not need to seek advice or request a letter from a medical professional about your reason for not wearing a face covering.

Carrying an exemption card or badge is a personal choice and is not required by law.’

The Government’s own interpretation of their law clearly states you do not have to prove your exemption from wearing a face covering. So therefore these security guards and Covid enforcement officers have no legal right to challenge you and you do not legally have to give them any form of excuse or exemption.

There is another law that is on the “exempts” side, and that is ‘The Equality Act 2010’. The act essentially makes service providers (i.e. shops) liable in civil claims for acts of disability discrimination against members of the public. So with ‘The Health Protection (Coronavirus, Wearing of Face Coverings in a Relevant Place) (England) Regulations 2020’ stating you do not have to wear one if exempt, and the Government’s own interpretation of the law stating you do not have to prove you are exempt, a denial of entry to Morrisons or Sainsbury’s because the words “I am exempt” are not enough, for the power hungry security guards and Covid enforcement officers, could be classed as discrimination and result in a hefty fine for the supermarkets.
